Kentucky Supreme Court reverses Appeal Court ruling on state's domain name seizures

The Kentucky Supreme Court has reversed the Kentucky Appeals court’s decision that dismissed governor's Beshear's attempt to seize 141 online domain names related to online poker, casinos and other gaming operators. In a hearing held yesterday at the Kentucky Supreme Court, judges ruled that they would not hear the case unless the real domain owners appear in court. The high court also determined that both, the Interactive Media Entertainment and Gaming Association (iMEGA), and the Interactive Gaming Council (IGC), have no standing to represent the domain owners in court.

“The court specifically noted in its order that only the domain name owners, operators, and registrants had a legal interest in the domain names and only they or their representatives could defend against forfeiture.” states the Supreme Court document.

Several pro-online gambling associations and poker players' groups, such as the Poker Players Alliance, have been watching the case closely. The Poker Players Alliance (PPA) Executive Director John Pappas, released an statement on the Kentucky Supreme Court ruling on the Commonwealth's appeal regarding its seizure of 141 internet gaming sites, including several of the leading sites where enthusiasts test their poker skills.

"The PPA understands the technical nature of the decision issued today by the Kentucky Supreme Court and remains confident that, once that issue is cured, the Supreme Court will address the compelling merits of the arguments in support of the Court of Appeals decision prohibiting the Commonwealth's seizure of 141 internet gaming sites.

There are fundamental freedoms at stake in this case, not only the freedom of poker players in Kentucky and globally, but Internet freedom across the globe. The Commonwealth's effort at such a bold, broad and, we believe, unlawful seizure sets a dangerous precedent for anyone who uses the Internet.

The PPA and its members continue to encourage Kentucky officials to work with us to implement common-sense licensing and regulation of online poker that will protect consumers and create a much needed revenue stream for the Commonwealth”. says the PPA statement.
