Free Poker Network files lawsuit against the State of New York

The Free Poker Experience, a company associated and representing the Free Poker Network, has filed a legal complaint in the Supreme Court of the State of New York to overturn a law that bans poker games within the state. The lawsuit filed by Free Poker Experience claims that other free tournaments and services are allowed in other industries. The suit states that “The statute denies equal protection of the laws, is arbitrary and capricious, selectively applied and enforced, and is in violation of other constitutional rights.”

“The law is wrong. If you risk nothing to play, then it shouldn’t be considered gambling. If you rule against us, we expect the State to storm the Harvard Club and the Yale Club and arrest anyone who plays bridge on Tuesday nights.” expressed Benjamin Scheck, Managing Member of the Free Poker Experience, in an interview given to a poker site this week.

The Free Poker Network representatives said the company has the potential to sign up about 1,000 bars and restaurants in the State of New York if the law would permit it, which could represent about $60,000 in weekly revenue for the company.  Every time the company signs up a new bar, it charges a $60 fee every time a free poker tournament takes place. The Free Poker Network gets a percentage of the fees charged to each bar and uses the remaining fraction to pay for a series of prizes, including seats at the World Series of Poker, World Poker Tour events, Heartland Poker Tour entries, as well as other prizes such as video game consoles, poker tables, etc.

The Free Poker Network currently organizes and runs tournaments in 11 states, including Maryland, Indiana, Florida, Minnesota, Nebraska, South Dakota, Tennessee, Texas, and Wisconsin. The Free Poker Experience told the media that it is working in other lawsuits in New Jersey as well as 28 other states in where poker tournaments are not permitted by the law.
